Assumption of Risk, Waiver, and Release of Liability Agreement

WARNING: PLEASE READ THIS ENTIRE DOCUMENT CAREFULLY. THIS IS A LEGAL AGREEMENT THAT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE FOR NEGLIGENCE! 

1- Activity

Roda Polo (the "Activity"), defined as playing polo using a mallet and ball while mounted on a motorized Electric Unicycle (E-Wheel) or similar personal electric mobility device. The Activity includes practice, training, competition, spectating, and all related equipment use and presence on the premises (the “Grounds”).

3- Acknowledgement and Assumption of Risk

I, the undersigned Participant, acknowledge and agree that Roda Polo is a high-risk, athletic, and potentially dangerous activity. I understand that the Activity is physically demanding and involves inherent risks that cannot be entirely eliminated, regardless of the care taken by the Organizers.

The inherent risks of Roda Polo include, but are not limited to, the following:

• Electric Unicycle (E-Wheel) Risks: Loss of balance, operational error, mechanical or electronic failure (including motor cutoff or sudden speed change), collision with fixed objects or other E-Wheels, and the resulting risk of a sudden fall onto hard surfaces (e.g., grass, dirt, concrete).
• Polo Game Risks: Being struck by a hard polo ball or a mallet swung by myself or another player.
• Collision Risks: Collisions with other participants, spectators, or staff.
• Environmental Risks: Uneven or slippery terrain, weather conditions, debris on the playing surface, and impact with goalposts.
• Equipment Failure: Failure of my own or provided safety equipment, including helmets, pads, or E-Wheel parts.

I understand that these risks may cause serious injury, including but not limited to, lacerations, broken bones, concussions, internal injuries, paralysis, and even death, and property damage.

I hereby confirm that I knowingly, voluntarily, and freely assume all risks, both known and unknown, associated with my participation in the Activity and my use of the Grounds and equipment.

4- Acknowledgement regarding rules and regulations of the activity

I, the undersigned participant, hereby acknowledge that I have read and understood the rules and regulations of the Activity, including but not limited to the safety guidelines, equipment requirements, and code of conduct. I understand that it is my responsibility to comply with all rules and regulations, and that failure to do so may result in my removal from the activity or other consequences. I hereby represent that I am aware of the risks and hazards associated with the activity, and that I am willing to accept those risks in order to participate. I agree to follow all instructions and guidance

5- Release and Waiver of Liability

In consideration of being permitted to participate in the Activity and use the Grounds, and pursuant to the Occupiers’ Liability Act(Ontario), I, on behalf of myself, my personal representatives, heirs, assigns, executors, and administrators, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the following entities and individuals (collectively, the "Released Parties"):

• Roda Polo Canada Academy
• Their officers, directors, employees, agents, volunteers, coaches, sponsors, successors, and assigns;
• The owners and lessors of the premises on which the Activity takes place.

This Release covers any and all claims, demands, losses, or damages, including those resulting from ORDINARY NEGLIGENCE on the part of the Released Parties, that I may incur as a result of my participation in the Activity or presence on the Grounds. THIS RELEASE DOES NOT APPLY TO CLAIMS ARISING FROM GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR RECKLESS DISREGARD.

6- Indemnification and Hold Harmless

I further agree to INDEMNIFY AND HOLD HARMLESS the Released Parties from any and all loss, liability, damage, or cost, including reasonable legal fees, which they may incur due to any claim brought by me, my family, or any third party arising out of my participation in the Activity, even if the liabilities arise from the Ordinary Negligence of the Released Parties. This indemnification does not extend to claims arising from the Released Parties' Gross Negligence or Intentional Acts.

7- Safety Equipment and Rules

I agree to be solely responsible for my own safety and the safety of my equipment. I certify that I will wear all required safety equipment at all times while mounted on or operating the E-Wheel during the Activity, including but not limited to:

• An approved helmet: ski, bike or skate helmet (mandatory).
• Protective eyewear (mandatory).
• Elbow, knee, and wrist guards (highly recommended).
• Footwear and leg protective gear (highly recommended):
  • Motocross or mountain bike boots.
  • Horse riding half chaps.
  • Gaiters with heel reinforcements.
  • Hockey or soccer shin guards worn covering the heel and calf.
  • The last 3 items must be worn with shoes that have rough rubber soles and good pedal grip.

I agree to comply with all stated and customary terms, conditions, rules, and regulations for participation, including all Roda Polo rules, and any verbal instructions given by staff or organizers. I acknowledge that failure to follow rules or wear required safety gear may be used to reduce or void any potential claim against the Organizers.

8- Medical Authorization and Insurance

In the event of an emergency or injury during the Activity, I understand that the organizers will take all reasonable steps to ensure my safety and well-being. I acknowledge that the organizers have a first aid kit and an emergency response plan in place, and that they will provide assistance to the best of their abilities in the event of an emergency.

I authorize the Released Parties to secure emergency medical treatment for me, if necessary, and I agree to be responsible for all costs of such treatment. I affirm that I possess adequate health, disability, and liability insurance to cover any injury or damage I may cause or suffer while participating.

10- Disclose of any pre-existing medical conditions or medical

I, the undersigned participant, hereby acknowledge that I have disclosed all relevant medical information, including any pre-existing medical conditions or medical history that may affect my participation in the Roda Polo activity. I understand that it is my responsibility to inform the organizers of any medical conditions that may impact my ability to participate safely in the activity. I hereby represent that I am physically and mentally capable of participating in the activity, and I acknowledge that I have not been advised against participating in the activity by a medical professional. I understand that the organizers reserve the right to refuse my participation in the activity if they deem it necessary to ensure my safety or the safety of others.

11- Governing Law and Jurisdiction (Ontario, Canada)

This Agreement and any rights, duties, and obligations as between the parties shall be governed by and interpreted solely in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any litigation involving the parties to this Agreement shall be brought solely within the Province of Ontario and shall be within the exclusive jurisdiction of the Courts of Ontario.

ant that I have read this document, fully understand its terms, and I am aware that by signing this Release Agreement I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators, assigns, and representatives may have against the Released Parties. I sign it freely and voluntarily without any inducement.
